Adayama Jiu-Jitsu Participation Waiver and Release of Liability
This Waiver and Release of Liability (the “Waiver”) is executed on {sign_date} by {name} (“Participant”), and if the Participant is under 18 years of age, their Parent/Guardian, {name}, in favor of Adayama Jiu-Jitsu (“Academy”), its owners, officers, directors, instructors, agents, employees, representatives, volunteers, and affiliated organizations (collectively referred to as “Released Parties”).
1. Acknowledgment of Risks
I, the Participant, understand and acknowledge that participation in Jiu-Jitsu, martial arts, fitness training, and related activities involves inherent risks, including but not limited to:
• Physical contact that may result in injuries such as bruises, sprains, dislocations, fractures, cuts, and other serious or catastrophic injuries.
• Risks of equipment malfunction or failure.
• The possibility of injury caused by other participants’ actions or negligence.
• The risk of contracting illnesses, including COVID-19 or other communicable diseases.
I voluntarily assume full responsibility for all risks, known and unknown, associated with participation in activities at the Academy.
2. Release of Liability
I, the Participant, for myself, my heirs, executors, administrators, assigns, and legal representatives, hereby release, discharge, and hold harmless the Released Parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, injury, illness, or damage that occurs as a result of my participation, including but not limited to:
• Negligence or alleged negligence of the Released Parties.
• Actions or omissions of other participants.
• Conditions at the Academy’s facilities or equipment.
3. Medical Consent and Emergency Treatment
I certify that I am physically fit, have no medical conditions that would increase the risk of injury, and have consulted a physician as necessary prior to participating in activities at the Academy. In the event of an emergency, I consent to medical treatment as deemed necessary by emergency responders or licensed medical professionals. I understand and accept full financial responsibility for any medical treatment received.
4. Consent to Use of Likeness
I authorize the Academy to use photographs, videos, or other recordings of me participating in activities for promotional, educational, or marketing purposes, without compensation or restriction. I waive any right to review or approve such uses.
5. Assumption of Responsibility for Minors
If signing on behalf of a minor Participant, I certify that I am the parent or legal guardian of the Participant and have the authority to sign this Waiver. I agree to the terms of this Waiver on behalf of the minor and assume full responsibility for their participation.
6. Compliance with Rules and Policies
I agree to follow all rules, policies, and instructions provided by the Academy’s instructors and staff. I understand that failure to comply may result in suspension or termination of my participation.
7. Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising out of my participation or my breach of this Waiver.
8. Severability
If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9. Governing Law and Jurisdiction
This Waiver shall be governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved exclusively in the state or federal courts located in San Diego County, California.
Acknowledgment and Agreement
By signing below, I acknowledge that I have read, understood, and agree to the terms of this Waiver. I further acknowledge that I am waiving certain legal rights and assume full responsibility for participation in the activities offered by the Academy.
